Who can make a CTP claim?

If you have been injured in a motor vehicle accident in Queensland and you were not responsible (or you were only partially responsible), you may have a right to claim. This includes drivers, passengers, motorcyclists, cyclists, pedestrians, bus and other road users.

What can I claim for?

You may be entitled to recover damages for your pain and suffering, past and future loss of income and superannuation, past and future medical, rehabilitation and other “out of pocket” expenses. Even the cost of paid care and  the voluntary assistance provided by friends and family can be claimed in many instances. A CTP claim does not cover damage to your vehicle or other property, but we are happy to give you advice on how to recover these losses too.

How much compensation am I entitled to?

Each and every case is different and can only be accurately assessed once all medical and other evidence is to hand. We will carefully consider every case individually to make sure that you claim everything that you are entitled to.

How long will it take for my claim to settle?

Every case is unique. Travis Schultz & Partners are motivated to get your claim finalised as efficiently and economically as possible, however, it is also important to ensure that your injuries have stabilised and all medical and other evidence has been obtained before you consider a settlement of your claim. After all, you only get one shot!

Claims involving serious injuries generally take a little longer as the medical professionals will generally want to allow the healing process to take place before they write an opinion about what the future prognosis might be. Most claims can be resolved within 6 to 24 months from when the accident occurred.

Will I need to go to court?

The vast majority of claims are resolved prior to a trial, and often settle at (or closely following) a settlement conference or mediation. Having a specialist legal professional that is highly experienced in claims of this type only helps to increase the chances that an early resolution will be achieved and that you get the best result possible.

Will the CTP insurer pay my medical bills?

Once a CTP insurer has admitted liability for the circumstances of the accident, they are obliged to pay “reasonable and appropriate” medical and rehabilitation expenses during the course of your claim. Where you’re entitled to rehabilitation funding, we will liaise with the insurer to have your expenses reimbursed, put funding arrangements in place with your treatment providers and make sure that the insurer lives up to their obligations to take the stress away and help you get back on your feet.

Will a public liability insurer pay my legal costs?

Under the legislation, the insurer may be required to make a contribution towards your legal costs at the successful conclusion of your claim. The amount of any contribution (if any) will depend upon the amount that your matter is ultimately resolved for.

It’s another reason why you need a highly experienced specialist in the field to maximise the amount that you can legitimately claim, and get a great outcome as a consequence. If you are entitled to recover some of your costs from the insurer, it’s normally an amount that represents 50 – 70 % of the legal costs you incur.
